On Thursday February 11, 2016 a Fargo ND police officer having been shot the night previous was taken off life support and died. He had been working an inner perimeter outside of the home of a man who was barricaded with firearms after a domestic dispute with his wife of 29 years began about 5:00 p.m. Officer Jason Moszer a decorated officer and Army Veteran Combat Medic had been shot at 9:10 p.m. The ND state Bureau of Criminal Investigation conducted an investigation and released a massive, and very redacted report 50 days later. The report implicated the perpetrator Marcus C. Schumacher Sr. a man under the influence of prescription and other drugs, with a record, but also an Army Veteran, husband and father for killing the officer. Mr. Schumacher was endangering the community that he was firing his weapons into. The states attorney determined that the SWAT sniper had acted reasonably and legally in firing upon and wounding the perpetrator. Mr. Schumacher, it was determined, killed himself about 10: 40 p.m. Wednesday February 10, 2016. Records disclosed and examination of statements and the appearance of ballistics suggests that the BCI did not tell a full story, one where more police weapons were likely fired - this fact being concealed from the public, likely motivated some officers, to include the sniper, to work to deny the perpetrator a trial. It appears the sniper Jerrod Wagner had committed some act of insubordination (shooting Of. Moszer in the head) and was placed under armed guard and continued to have discretion to end life rather than being relieved from duty during this very dangerous situation. NORTH DAKOTA POLICE HIDE CRITICAL EVIDENCE IN HOMICIDE - CONSPIRE TO DENY TRIAL TO PERPETRATOR UNDER EVERY CIRCUMSTANCE TO HIDE NEGLIGENT FIRE - NOT FRIENDLY FIRE - NEGLIGENT FIRE. Numerous documents are submitted to the sole investigating agency for the entire case -
the North Dakota Bureau of Criminal Investigation, time and time again the documents- reports
from individual police officers are restated in BCI alleged to be reports, other times the reported
alleged facts are simply not followed-up on by BCI. Some documents will not be released to
Media, even highly redacted. Detective Gabrielson states over and over that he and "they" had
been advised of one alleged fact or another - but not who the advisor(s) were.
Mr. Schumacher bad deeds are reported, over reported and some conclusions are
misstated and some based on no evidence. Clear evidence of Police weapons firing unreported
to the public and in some instances the media, are suppressed. Some documents are in private,
non-governmental and as such only in the possession of this writer, and not reported by BCI
regarding police apparent suppression and corruption only because LA Sevareid Newsgroup
alone paid over $750.00 in fees (electronic records are according to AG office free - not here
however) for thousands of City of Fargo and City of Fargo - Police e-mails, days (August 2016)
before they would have automatically been deleted for all time off city servers. BCI involvement
in this matter and in some instances - police - that is to say especially the Red River Valley SWAT
team appear criminally negligent.
This exceeds the limits of what what North Dakota can honestly investigate and report honestly
itself when it was decided by those same individuals to proceed corruptly on February 11, 2016.

"totally unknown" "inquiry into 5 unaccounted for fired police rounds, over quick -- "totally unknown" this is written by the appointed to take photos Cass County Detective at the north garage crime scene where Officer Jason Moszer had been shot at 2110 hrs Wednesday 10 FEB16 -- the individuals in charge of the entire investigation the next morning, BCI made no inquiries into the 5 rounds unaccounted for -- 4 brass - shot expended shells, not taken into evidence, that is to say -a chain of custody inventory - all 4 are .308 sniper fired ammunition, including the 2 rounds allegedly fired by alleged police sniper. The two observed at the sniper hide shells are treated as importantly as a pair of gloves and a blanket - thrown into a car or pocket. The two sniper hide rounds can not be the 2 rounds found at 3rd street and 10th Avenue as they are there before BCI is done with sniper hide crime scene "inventory" 0745 11 FEB 16. Detective Gabrielson and BCI are back at garage by 0724 sun-up.
it appears then .308 sniper rifle(s) are fired at least four times in incident. In the incident only SWAT snipers possess .308 rifles and
only police and not alleged suspect Mr. Schumacher who possess .223
firing long guns, none of which no M4 .223s, rifle(s), ammunition or brass are presented to the state lab - Mr. Jacobson the state forensic scientist. The utilization of a standardized evidence, inventory, custody sheet, is spotty; the determination of what is and is not important, essential and obviously so, evidence of deliberate weapons firing appear unprofessional, function as to facilitate the disappearance and alleged reappearance of weapons (esp. police weapons firing) brass and truly in the real world appearance of bullet projectiles - instances where the essential evidence inventory custody sheet is not utilized - especially at crime scenes outside the Schumacher home itself. The difference in the apparent degree of professionally gathered "evidence" by the BCI team in the home (where alleged perpetrator Schumacher is located throughout the incident) and the marked unprofessionality of the "investigation(s) ", statements, omissions, mishandling of evidence at crime scenes - for instance, a. the alley area where Officer Moszer is gravely wounded. b. the home across the street from the Schumacher home where until now the identification of hidden eyewitness to shooting observed from kitchen window; also where SWAT sets up upstairs to be on point to engage Mr. Schumacher. It was here where the statement that a Schumacher fired high power projectile came to rest on the window sill area, upstairs. The projectile is described in no detail, it is not taken into evidence with the registering of the evidence onto a evidence, inventory and custody sheet. The description of the projectile and how it came to be where allegedly it came to rest is not consistent with the evidence provided to the state lab, as the state forensic scientist ruled out Mr. Schumacher's only high powered rifle used in the incident a .243 as having anything to do with any bullets, bullet residue, evidence - outside of his home itself. The story of the high powered bullet on the window sill and it's mishandling rings false.

States Attorney Burdick is correct in stating only two rounds were fired by police at Schumacher. This in his three page memorandum considering whether or not Sniper Jerrod Wagner had legitimately used deadly force, it was determined that legally he had.
However more police ammunition WAS FIRED by police and NOT REPORTED AS SUCH, this goes to fear and greed and urge to kill gone amok as the Fargo Police Department has proven that it dislikes a
requirement that they tell the truth - completely under all circumstances - and as their disciplinary requirement are written the
requirement that former Chief Ternes and at the time Deputy Chief Todd and the two other Deputy Chiefs insisted be followed, AND IT MUST!) if a more senior officer is lied to the lying Officer is out.
Knowing that the Fargo P.D. wanted an investigation that would,
sidestep the rule as written and everyone who knows the truth will get
to walk in re Schumacher as the regs do not cover lying to another
organization that does not ask any difficult questions - and looks into nothing that points directly at 2-3 more .308 sniper rounds fired and asks and covers up EVERYTHING that would suggest that at 2130 hours - nameless, faceless unaccountable BCI agents bags up possible .223 brass from Officer Moszer's M4 rifle. The state scientist Mr. LaMonte Jacobson does not even test the Schumacher .243 high powered rifle - not because he is at all negligent - it is because he knows what he knows and a pertinent rifle is not presented to him and Schumachers high powered rifle - fired 6 times - known to be from the 6 expended rounds in his home to include we presume the suicide round... No bullet projectile, no bullet residue, nothing out of the .243 of Schumacher's rifle is connected with any collected evidence in the case. This leaves, to implicate Mr. Schumacher, only one .22 caliber semi-automatic Ruger 10/22 rifle, which is fed by 10 shot clips. Jacobson can not match definitively a Schumacher .22 as responsible for Officer Moszer's mortal wound. BCI does not submit Officer Moszer's M4 for examination. The diameter of a .22 caliber and the M4s .223 are very similar in diameter.

Even Fargo Police Chief Todd has stated (Forum 7 FEB 17) that NO bullets from Schumacher to the south passed through the garage - yet here on North side of Officer Moszer down garage on north side are what every person who has looked at these bullet holes state are incoming that directly collaborates Neighbor not interviewed by Police Mr. Ken Phaff who has stated definitely and unqualified that bullets came from the NORTH of Officer Moszer's position (specifically stated he may be quoted). AND Deputy digging bullets out of another garage north of this WEEKS after incident. Note Mr. Schumacher was never in a position north of the alley garage and therefore could NOT have fired the shots from the North. Did Officer Moszer's M4 discharge - rifle was NOT submitted to state lab for analysis.

The deep state’s decision in ancient Rome—dominated by a bloated military and a corrupt oligarchy, much like the United States of 2017—to strangle the vain and idiotic Emperor Commodus in his bath in the year 192 did not halt the growing chaos and precipitous decline of the Roman Empire.
Commodus, like a number of other late Roman emperors, and like President Trump, was incompetent and consumed by his own vanity. He commissioned innumerable statues of himself as Hercules and had little interest in governance. He used his position as head of state to make himself the star of his own ongoing public show. He fought victoriously as a gladiator in the arena in fixed bouts. Power for Commodus, as it is for Trump, was primarily about catering to his bottomless narcissism, hedonism and lust for wealth. He sold public offices so the ancient equivalents of Betsy DeVos and Steve Mnuchin could orchestrate a vast kleptocracy.

Commodus was replaced by the reformer Pertinax, the Bernie Sanders of his day, who attempted in vain to curb the power of the Praetorian Guards, the ancient version of the military-industrial complex. This effort saw the Praetorian Guards assassinate Pertinax after he was in power only three months. The Guards then auctioned off the office of emperor to the highest bidder. The next emperor, Didius Julianus, lasted 66 days. There would be five emperors in A.D. 193, the year after the assassination of Commodus. Trump and our decaying empire have ominous historical precedents. If the deep state replaces Trump, whose ineptitude and imbecility are embarrassing to the empire, that action will not restore our democracy any more than replacing Commodus restored democracy in Rome. Our republic is dead.
Societies that once were open and had democratic traditions are easy prey for the enemies of democracy. These demagogues pay deference to the patriotic ideals, rituals, practices and forms of the old democratic political system while dismantling it. When the Roman Emperor Augustus—he referred to himself as the “first citizen”—neutered the republic, he was careful to maintain the form of the old republic. Lenin and the Bolsheviks did the same when they seized and crushed the autonomous soviets. Even the Nazis and the Stalinists insisted they ruled democratic states. Thomas Paine wrote that despotic government is a fungus that grows out of a corrupt civil society. This is what happened to these older democracies. It is what happened to us.
Our constitutional rights—due process, habeas corpus, privacy, a fair trial, freedom from exploitation, fair elections and dissent—have been taken from us by judicial fiat. These rights exist only in name. The vast disconnect between the purported values of the state and reality renders political discourse absurd.
Corporations, cannibalizing the federal budget, legally empower themselves to exploit and pillage. It is impossible to vote against the interests of Goldman Sachs or ExxonMobil. The pharmaceutical and insurance industries can hold sick children hostage while their parents bankrupt themselves trying to save their sons or daughters. Those burdened by student loans can never wipe out the debt by declaring bankruptcy. In many states, those who attempt to publicize the conditions in the vast factory farms where diseased animals are warehoused for slaughter can be charged with a criminal offense. Corporations legally carry out tax boycotts. Companies have orchestrated free trade deals that destroy small farmers and businesses and deindustrialize the country. Labor unions and government agencies designed to protect the public from contaminated air, water and food and from usurious creditors and lenders have been defanged. The Supreme Court, in an inversion of rights worthy of George Orwell, defines unlimited corporate contributions to electoral campaigns as a right to petition the government or a form of free speech. Much of the press, owned by large corporations, is an echo chamber for the elites. State and city enterprises and utilities are sold to corporations that hike rates and deny services to the poor. The educational system is being slowly privatized and turned into a species of vocational training.
Wages are stagnant or have declined. Unemployment and underemployment—masked by falsified statistics—have thrust half the country into chronic poverty. Social services are abolished in the name of austerity. Culture and the arts have been replaced by sexual commodification, banal entertainment and graphic depictions of violence. The infrastructure, neglected and underfunded, is collapsing. Bankruptcies, foreclosures, arrests, food shortages and untreated illnesses that lead to early death plague a harried underclass. The desperate flee into an underground economy dominated by drugs, crime and human trafficking. The state, rather than address the economic misery, militarizes police departments and empowers them to use lethal force against unarmed civilians. It fills the prisons with 2.3 million citizens, only a tiny percentage of whom had a trial. One million prisoners work for corporations inside prisons as modern-day slaves.
The amendments of the Constitution, designed to protect the citizen from tyranny, are meaningless. The Fourth Amendment, for example, reads: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” The reality is that our telephone calls, emails, texts and financial, judicial and medical records, along with every website we visit and our physical travels, are tracked, recorded and stored in perpetuity in government computer banks.
The state tortures, not only in black sites such as those at Bagram Air Base in Afghanistan or at Guantanamo Bay, but also in supermax ADX [administrative maximum] facilities such as the one at Florence, Colo., where inmates suffer psychological breakdowns from prolonged solitary confinement. Prisoners, although they are citizens, endure around-the-clock electronic monitoring and 23-hour-a-day lockdowns. They undergo extreme sensory deprivation. They endure beatings. They must shower and go to the bathroom on camera. They can write only one letter a week to one relative and cannot use more than three pieces of paper. They often have no access to fresh air and take their one hour of daily recreation in a huge cage that resembles a treadmill for hamsters.
The state uses “special administrative measures,” known as SAMs, to strip prisoners of their judicial rights. SAMs restrict prisoners’ communication with the outside world. They end calls, letters and visits with anyone except attorneys and sharply limit contact with family members. Prisoners under SAMs are not permitted to see most of the evidence against them because of a legal provision called the Classified Information Procedures Act, or CIPA. CIPA, begun under the Reagan administration, allows evidence in a trial to be classified and withheld from those being prosecuted. You can be tried and convicted, like Joseph K. in Franz Kafka’s “The Trial,” without ever seeing the evidence used to find you guilty. Under SAMs, it is against the law for those who have contact with an inmate—including attorneys—to speak about his or her physical and psychological conditions.
And when prisoners are released, they have lost the right to vote and receive public assistance and are burdened with fines that, if unpaid, will put them back behind bars. They are subject to arbitrary searches and arrests. They spend the rest of their lives marginalized as members of a vast criminal caste.
The executive branch of government has empowered itself to assassinate U.S. citizens. It can call the Army into the streets to quell civil unrest under Section 1021 of the National Defense Authorization Act, which ended a prohibition on the military acting as a domestic police force. The executive branch can order the military to seize U.S. citizens deemed to be terrorists or associated with terrorists. This is called “extraordinary rendition.” Those taken into custody by the military can be denied due process and habeas corpus rights and held indefinitely in military facilities. Activists and dissidents, whose rights were once protected under the First Amendment, can face indefinite incarceration.
Constitutionally protected statements, beliefs and associations are criminalized. The state assumed the power to detain and prosecute people not for what they have done, or even for what they are planning to do, but for holding religious or political beliefs that the state deems seditious. The first of those targeted have been observant Muslims, but they will not be the last.
The outward forms of democratic participation—voting, competing political parties, judicial oversight and legislation—are meaningless theater. No one who lives under constant surveillance, who is subject to detention anywhere at any time, whose conversations, messages, meetings, proclivities and habits are recorded, stored and analyzed, who is powerless in the face of corporate exploitation, can be described as free. The relationship between the state and the citizen who is watched constantly is one of master and slave. And the shackles will not be removed if Trump disappears.© 2017 TruthDig
